Qualitative research, on the other hand, uses mock trial and jury focus groups. Due to the fact that the number of participants is smaller, qualitative research tends to be more in-depth and personalized. This is typically the form of jury research most attorneys use.

During a mock trial, an attorney will outline their opening and closing remarks, witness testimonies, and other evidence. A mock trial can take just a couple of hours or an entire day, and participants are usually compensated. Still, mock trials can also help attorneys analyze group dynamics and nonverbal communication, draft questions and scripts, and identify the criteria and goals of the jury once one is selected.
