Practice Questioning

Practicing the questions you will ask under direct examination can make witnesses feel more confident on the stand. You can advise them not to guess about facts, to not comment when they do not know or remember, and to not provide more information than what was asked. It is just as important, if not more so, that you practice an unpleasant cross-examination. This will ensure witnesses do not become confused or rattled, even if that is the goal of opposing counsel.

Do Not Practice Too Much

Again, you need your witnesses to appear comfortable and natural. Over rehearsing can make witnesses appear scripted and calculated, which does not resonate with juries. Practice just until a witness knows what to expect and until they feel comfortable and leave the rest for trial.
