Philadelphia Jury Focus Groups

Jury research is an important tool before any trial. This research allows attorneys to test the evidence and themes within a case in front of individuals similar to those who will decide the actual case. This allows attorneys to identify the strengths and weaknesses of their case. Once identified, an attorney can determine the appropriate approach to take, whether that is a settlement or proceeding with trial and arguing their case.

The Drawbacks of Mock Trials

Mock trials are the traditional method for testing jury cases. During a mock trial, lawyers representing the different sides in a case present evidence and arguments to a group of surrogate jurors. Opening and closing arguments are made and witnesses can be present either live or via video. After hearing all sides of the case, the surrogate jurors will make a decision on the case.

While mock trials are often used by attorneys, they do have some drawbacks. These include:

  • It can be challenging to properly simulate the other side’s arguments.
  • A mock trial can showcase weaknesses in a case at a point when it is too late to correct the problem.
  • Different presenters can have different advocacy levels.
  • There are often insufficient resources to properly test the case.

How are Philadelphia Jury Focus Groups Different from Mock Trials?

Focus groups are similar to mock trials, but the two do have their differences. Focus groups are not adversarial and they do not replicate every aspect of an actual trial. Instead, only the main evidence and themes are presented to the jury focus group.

Also unlike a mock trial, only one presenter summarizes the themes and evidence in the entire case. The summaries are supplemented with documents and other evidence that showcase the main points each side will argue during the actual trial. Like in a mock trial, summaries and witness videos are presented to the focus group and the group of individuals will then make a decision.

Benefits of Jury Focus Groups Over Mock Trials

Mock trials and jury focus groups both have their advantages. With a jury focus group, there is just one presenter and they present the theme and evidence in a case in a neutral manner. This also removes the concern that the other side is not properly represented. Instead of the style of the presentation, surrogate jurors can focus on the information being presented.

Due to the fact that focus groups do not try to represent the entirety of a trial, they can be conducted much earlier in the process. This gives attorneys time to correct problems a jury focus group may expose.
